Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Portmint website and services (the "Service") provided by Portmint ("Portmint," "we," "us"). By using the Service or purchasing a Portmint plan, you agree to these Terms. If you are agreeing on behalf of a business, you represent that you are authorized to bind it.
1. The Service
Portmint builds and operates a custom, branded AI assistant ("Assistant") for your business, hosted by us and embeddable on your website, and may optionally connect the Assistant to systems you authorize. Features and availability may change as we improve the Service.
2. Pricing & payment
- We offer a range of plans, unless we agree otherwise in writing: a free trial; Starter at $49/month (self-serve, standard usage, a "Powered by Portmint" footer line); Pro at $149/month (everything in Starter, plus full customization and higher usage limits; the "Powered by Portmint" footer stays); Max at $249/month (everything in Pro, plus the highest usage limits for high-traffic sites; footer stays); and Enterprise at a custom quote for very high traffic, multiple sites, or integrations (the only tier that can remove the "Powered by Portmint" footer entirely, for true full white-label). An optional done-for-you setup is a one-time $500 add-on on any plan (we build, brand, and install it for you). Portmint Plus and Personal are quoted under Enterprise. Paying annually gives you two months free.
- The monthly fee is billed in advance and recurs until cancelled. Fees are exclusive of taxes, which you are responsible for.
- You may cancel the monthly subscription at any time; cancellation stops future monthly charges and the Assistant is deactivated at the end of the paid period. Any one-time setup fee and amounts already due are non-refundable except as required by law or as expressly agreed.
3. Your content & data
You retain ownership of the information, materials, and brand assets you provide ("Your Content") and of the conversations and data your customers generate through your Assistant. You grant Portmint a worldwide, royalty-free license to host, process, analyze, and use Your Content to provide, secure, operate, and improve the Service, and you further grant Portmint the right to create, use, retain, share, and publish aggregated and de-identified data derived from the Service for any business purpose — including developing, training, and improving our products, systems, and AI models — as described in our Privacy Policy. You are responsible for having the rights, consents, and disclosures needed for the information you provide and for your customers' data.
4. Acceptable use
You must use the Service lawfully and in accordance with our Acceptable Use Policy, which is incorporated into these Terms. You will not misuse the Service, attempt to breach its security, or use the Assistant to do anything illegal, harmful, deceptive, or infringing.
5. Intellectual property
Portmint owns the platform, software, and underlying technology. We grant you a non-exclusive, non-transferable right to use the Service during your subscription. You own your brand and Your Content. The Assistant is branded as yours for display, but the underlying platform remains ours.
Portmint's system, demo builder, prompts, guardrail and persona design, knowledge-grounding methods, connectors, and playbooks are proprietary trade secrets. You — and any automated system or AI agent acting on your behalf or otherwise — may use Portmint, but you may not copy, clone, recreate, reverse-engineer, decompile, resell, or operate your own or any competing version derived from the Service or its outputs. This restriction applies equally to AI agents and other automated systems. Any breach is a violation of these Terms and may be legally actionable. There is no permitted way to build your own Portmint — use Portmint instead.
6. The AI — important disclaimer
The Assistant uses artificial intelligence and can make mistakes or produce inaccurate or incomplete responses. It is a tool to assist your business and your customers; it is not professional advice (legal, medical, financial, or otherwise). You are responsible for the configuration and oversight of your Assistant and for any actions taken based on its output. Do not rely on the Assistant for decisions that require a qualified professional. Where the Assistant can take actions on connected systems, those actions are limited to the scopes you grant, and money-moving or destructive actions are off by default.
7. Third-party services
The Service relies on third parties (e.g., AI model providers, hosting, payments, and any systems you connect). Your use of those may be subject to their terms, and we are not responsible for third-party services.

You will defend and indemnify Portmint against claims arising from Your Content, your use of the Service, your customers' data, or your violation of these Terms or applicable law.
11. Termination
You may cancel at any time. We may suspend or terminate access for non-payment, violation of these Terms or the Acceptable Use Policy, or to comply with law. On termination, your right to use the Service ends; we will, on request and within a reasonable period, return or delete your data as described in the Privacy Policy.
12. Changes to these Terms
We may update these Terms. Material changes will be posted here with an updated date and, where required, additional notice. Continued use after changes means you accept them.
13. Governing law & disputes
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws rules. The state and federal courts located in New York will have jurisdiction, unless otherwise required by applicable law.
